The following contractual terms apply to all purchase contracts concluded between:

And their customers acting as consumers – buyers – via the seller's online shops. These terms do not apply to direct sales made on-site at the seller's premises. For such sales, separate general terms and conditions apply, which are posted at the seller's business premises. The contract language is German.

1. Scope, Definitions

1.1 For online purchase transactions between seller and buyer, only these general terms and conditions in their current version apply.
1.2 These terms apply only to purchases by consumers. Consumers are natural persons concluding a legal transaction for purposes not attributed to their commercial or self-employed professional activity.
1.3 Online purchases of alcoholic beverages may only be concluded with persons aged 18 and over. By accepting these terms before ordering, the buyer confirms they are of legal age to purchase alcohol. For age-restricted items, we ensure minimum age verification through a reliable personal identity and age check. Delivery is only after successful age verification.

2. Conclusion of Contract

2.1 Orders in the seller's online shop are only possible via the internet.
2.2 The buyer selects products (Greek and Mediterranean wine, fish, and delicacies) and submits their order via the “Place Order” button, creating a binding purchase offer. Data can be reviewed and edited before submission. Orders require explicit acceptance of these terms via a checkbox.
2.3 The seller will confirm receipt by email immediately. The purchase contract is only concluded upon a second email (shipping confirmation), sent within max. 5 days. Multiple shipping confirmations may occur if items ship separately (e.g., perishables via express to maintain cold chain).
2.4 The purchase contract covers only items ordered by the buyer and offered by the seller in the online shop. Unless otherwise stated, descriptions and prices refer to listed items only, excluding accessories or decorations.

3. Retention of Title

Goods remain the property of the seller until full payment of all claims arising from the purchase contract.

4. Prices and Shipping Costs

All prices are gross prices (including VAT). Shipping costs are calculated separately. See the “Shipping” section.

5. Payment and Shipping Terms

5.1 Current payment terms are listed under the “Payment Methods” section.
5.2 Payment options within Germany:

  • Prepayment (bank transfer)

  • Cash on delivery

  • PayPal

  • PayPal Plus (invoice, direct debit, credit card – PayPal account not required)

  • SOFORT transfer

5.3 For prepayment, payment is due within 14 days of order confirmation. Shipping only occurs after payment.
5.4 PayPal Plus offers various options, with details in the order process.
5.5 For cash on delivery, an additional €7.50 fee applies.
5.6 For SOFORT, buyers must have online banking with PIN/TAN. Payment is immediate after confirmation.

6. Delivery, Transfer of Risk

6.1 Delivery times are stated on product pages. Delivery time includes transport duration, which varies depending on distance and customs clearance if applicable.
6.2 Shipping is via DHL or UPS within the EU only.
6.3 The seller may deliver orders in multiple shipments if reasonable for the buyer.
6.4 Risk transfers to the buyer upon receipt or if acceptance is delayed.
6.5 If the buyer refuses acceptance or delays cooperation, the seller can claim resulting damages (e.g. storage or transport costs).

7. Withdrawal

The seller may withdraw from the contract if:

  • Incorrect or delayed self-supply not caused by the seller occurs. The buyer will be informed immediately of non-availability.

  • Delivery fails three times.

Payments already made by the buyer will be refunded. Legal withdrawal rights (§§ 346 ff. BGB) apply.

8. Defects, Warranty

8.1 Statutory warranty rights apply. Obvious transport damages must be reported immediately to the carrier and seller.
8.2 Warranty period: two years from delivery.
8.3 Warranty excludes normal wear and tear or defects caused after delivery by external influences or improper handling.

9. Liability for Other Breaches

9.1 Liability for breaches not involving defects follows statutory provisions.
9.2 Seller is liable only for intent and gross negligence, except for injury to life, body, or health, or breach of essential contractual obligations (those necessary for the purpose of the contract). In such cases, liability is limited to foreseeable, typical damages.
9.3 Claims under the Product Liability Act remain unaffected.

10. Right of Withdrawal

Consumers have a statutory right of withdrawal. Full information is available under “Right of Withdrawal” and is included in order confirmations.

11. Data Storage and Processing

The seller stores the contract text and sends order data and shipping confirmations by email. Terms can be viewed anytime. Past orders can be viewed in the customer account.

12. Dispute Resolution

The EU provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr/
The seller is neither obliged nor willing to participate in dispute resolution before a consumer arbitration board.

13. Final Provisions

13.1 German law applies, excluding UN sales law.
13.2 Invalidity of individual provisions does not affect the validity of remaining provisions.
